POLICY:
In the event of the demise of an active member ("...a member shall have signed the membership roll and shall have regularly contributed to the support of the church and regularly attended church services if physically able to do so." ICFG Bylaws, 13.6.3A) and/or their immediate family member (mother, father, husband, wife, sisters, brothers, children, grandparents, grandchildren, step-children and step-parents) repast privileges will be extended by the Los Angeles Shabach Foursquare Church (LASFC) along with a floral arrangement (up to $125) or $100.00 donation.

The repast privileges will have the following guidelines:

  1. To be eligible for these privileges, the funeral or memorial service must be held within Los Angeles County or at the National Cemetery in Riverside.
  2. Los Angeles Shabach Foursquare Church (LASFC) will not provide food service of any description nor will repasts be held at its facilities. This policy does not prevent individual members from serving the family in any way they deem appropriate.
  3. Should the eligible immediate family communicate to the designated EMBRACE leader the desire to have a repast at a restaurant following said services, LASFC will contribute up to $15 a person (this amount is inclusive of meal, tax, and gratuity) with a maximum of no more than $500. These funds will only be paid directly to designated restaurant.
  4. Should the eligible member prefer to have a repast in their home or some other place, LASFC will contribute to the purchase of food from an establishment and/or caterer. The establishment/caterer will be paid directly upon receipt of invoice. The maximum is the same as above (no more than $500). Any amount over this will be the responsibility of the family.
  5. These benefits shall be extended to the family of the deceased (as a whole), not on an individual basis. Example, in the event there is more than one family member who is an active member of Shabach, the benefits will be extended to the designated family representative. (Approved and amended 3/8/2014)
  6. No alcoholic beverages will be purchased by Los Angeles Shabach Foursquare Church. EMBRACE WILL BE THE OFFICIAL SPOKESPERSONS TO THE FAMILY for this policy.

POLICY:
Upon initial knowledge of any serious illness or incapacitating injury(ies) of a member and/or immediate family member (mother, father, husband, wife, sisters, brothers, children, grandparents, grandchildren, step-children, and step-parents):

  1. The first person(s) receiving the information will pray (at that time).
  2. This information is to be immediately given to the intercessors for prayer.
  3. A card, acknowledging said illness and/or injury(ies), will be sent by a designated ministry representative to the appropriate party.
    In the event of hospitalization (inpatient admission), residential/convalescent care (incapacitation):
    In addition to the above, a plant will be given upon the 3rd day of hospital admission or long-term convalescence of more than 2 weeks. One (1) plant will be given per six (6) month period, per person.
    Every report of serious illness and/or incapacitating injury(ies) will be acknowledged by prayer and a card.

In order to maintain tax-exempt status, Churches must continue to meet at least two separate tests:

  1. No person or persons may own the Church, receive funds from it or have a right to take property from it. This test is Basic to the original test of a properly operated and compliant Church.
  2. The Church must operate "exclusively" for its particular exempt purpose and must not devote itself to benefiting private individuals. The statute 501(c)(3) uses the term "inurement" for this purpose i.e., "no part of the net earnings of which inure to the benefit of any private shareholder or individual").
    Inurement means to serve to the use or benefit of, as a gift of land inures to the heirs of a grantee or it inures to their benefit (Webster's Deluxe Unabridged Dictionary 2nd Ed.).
    Basically, inurement is generally found to exist in the setting of tax-exempt organizations where money or something of value is transferred to or otherwise benefits an individual because of that person's relationship with the organization, and without regard to accomplishing the organization's exempt purpose.
    Although the statute suggests that inurement involves only "private shareholders or individuals," the IRS and courts have interpreted this group generally to include all persons having a personal and/or private interest in the activities of the tax-exempt organization. Although most inurement violations involve persons in "control" positions within the particular organization, this is not always the case and inurement may involve someone who is not an insider.
    The terms "shareholder" and "individual" cover the following groups for inurement purposes:
  3. Any person with the authority to decide to make payments of the Church's money;
  4. A member of the family of such person;
  5. A substantial contributor to the Church who could possibly influence the Church's decisions; and
  6. Affiliates of the above.
    A good example of inurement is a Pastor who is paid excessively by his Church. Also interest-free loans, percentage fundraising, or excess employment perquisites.
    What happens when inurement occurs? Who is affected by an act of inurement?

It is the policy of the Los Angeles Shabach Foursquare Church (hereafter known as "the company" and/or "company") that our passenger vehicles (including vans and light-duty trucks) will be used only for company business and will be operated only by authorized persons who meet the driver criteria in our vehicle safety program. This policy applies to our company-owned vehicles and private or rental vehicles authorized for use on company business.
All employees/volunteers must comply with federal, state, and local laws and policies and be physically and mentally able to do their jobs. Church employees and volunteers must not use intoxicants, drugs, or medications that could impair their judgment or ability to drive.
Employees/volunteers who drive on company business must have a valid driver’s license and a satisfactory driving record.
Violations of this policy may result in revocation or restriction of employee/volunteer authorization to drive a company-owned or private vehicle on company business, reassignment, demotion, suspension, or dismissal.
Employees/volunteers are strongly encouraged to plan mini-breaks every two hours during long periods of driving and to allow for no more than 10 hours of driving per day in good driving conditions.
Employees/volunteers must use and require seat belts to be worn by their passengers.
Employees/volunteers are responsible for the care of vehicles assigned to them and may be held liable for improper care and abuse of the vehicle. Misconduct could lead to withdrawal of driving privileges and/or disciplinary actions, up to and including dismissal.
Employees/volunteers who drive on company business must have a current, valid license for the vehicles they drive. Licenses will be photocopied and kept in employees' files.
Employees/volunteers who drive personal vehicles on company business must provide evidence of automobile liability insurance as required by the state of California. A current certificate or proof of insurance must be kept in the employee's file.
Employees/Volunteers are responsible for all traffic and parking violations they receive when using company or private vehicles.

Authorization to use a personally owned vehicle for company business is permitted under the following conditions:

  • Employees/volunteers and passengers must wear seat belts while the vehicle is in motion.
  • Employees/volunteers must have a valid driver's license for the vehicles they will operate, must follow all license restrictions, and must have their license in their possession when they are driving. A driver whose license is suspended, revoked, or terminated will notify the company immediately.
  • Employees/volunteers must provide proof of insurance upon each time their policy is renewed or updated.
  • Employees/volunteers must notify this company or all vehicle accidents or violations involving vehicles driven on company business.
    Employees/Volunteers are responsible for all traffic and parking violations they receive when using company or private vehicles.
    The vehicle owner is responsible for mechanical repairs.
    Employees/volunteers are not allowed to operate vehicles while under the influence of alcohol, drugs, or other medications that could impair their ability to drive safely.
    Employees/volunteers must comply with all state and federal laws and regulations at all times.
    I have read, understand, and agree to comply with this Vehicle Use Agreement and Safe Driving Policy. I also understand that it is my responsibility to operate vehicles safely and follow the requirements of the company's Safe Driving Policy. I also understand that the company will periodically review my Driver's License and insurance coverage.
